This Agreement will become effective in relation to you when you have been accepted as a member and will remain effective until terminated by you or Thunderhoney. You may cancel your membership at any time by visiting your membership page which termination shall have effect at the expiry of submission. Thunderhoney reserves the right to terminate this Agreement or suspend your membership at any time in case of unauthorized, or suspected unauthorized use of the service whether in contravention of this Agreement or otherwise. If Thunderhoney terminates this Agreement, or suspends your account for any of the reasons set out in this section, Thunderhoney shall have no liability or responsibility to you.

By becoming a member of Thunderhoney you agree to the following terms and conditions regarding any and all musical recordings (as defined as “Tracks” below):

“Track” or “Tracks” means every form of recording of Works, whether now known or unknown, embodying sounds and recorded vocals and/or other sounds and/or musical recordings provided by Thunderhoney. “Work” or “Works” means the underlying composition (both music and lyrics) in and to a Track and any variations thereof.

All tracks available through thunderhoney.com may only be downloaded for licensing use. A track may only be used for licensing purposes after explicit approval from Thunderhoney. A request to use a song should be emailed to requests@thunderhoney.com or directly to a Thunderhoney employee. The approval or denial to use the song will then be emailed back to you promptly. All tracks available through thunderhoney.com are pre cleared with the recording artist or other rights owners.

Thunderhoney respects intellectual property rights, and expects you to do the same. Please note therefore that the Tracks and content provided through Thunderhoney is the property of or is controlled by Thunderhoney or its suppliers and is protected by intellectual property rights and that you do not have a right to use the content in any manner not covered by this Agreement, thus, you may not infringe any third party’s intellectual property rights in and to the Tracks and content. All rights not expressly granted are reserved by Thunderhoney and its suppliers.

In no event will Thunderhoney or its suppliers be liable to you for any damages, claims or costs whatsoever or any consequential, indirect, incidental damages, or any lost profits or lost savings, even if a Thunderhony representative has been advised of the possibility of such loss, damages, claims or costs or for any claim by any third party. The foregoing limitations and exclusions apply to the extent permitted by applicable law in your jurisdiction.

Nothing contained in this Agreement limits Thunderhoney’s liability to you in the event of death or personal injury resulting from Thunderhoney's negligence or for the tort of deceit (fraud). Thunderhoney is acting on behalf of its suppliers for the purpose of disclaiming, excluding and/or limiting obligations, warranties and liability as provided in this Agreement, but in no other respects and for no other purpose.

This Agreement will be governed by and construed in accordance with the substantive laws in force in Sweden. The competent courts of Sweden, shall have exclusive jurisdiction over all disputes relating to this Agreement.
